A-Rod reaches divorce settlement
New York Yankees superstar Alex Rodriguez and his wife, Cynthia Rodriguez, reached a settlement agreement in their multi-million dollar divorce case late last week. Cynthia Rodriguez filed for divorce in July after more than five years of marriage, citing A-Rod’s alleged infidelities. The couple opted to keep the terms of their divorce private, though both parties say the agreement was amicable and in the best interest of their two daughters. A pre-nuptial agreement was in place before the couple was married. Although not disclosed, A-Rod and Cynthia’s prenuptial agreement was most likely the driving force behind the couple privately settling the divorce case.
Cynthia Rodriguez filed for divorce in Florida, where she lives. Florida is a no-fault divorce state, meaning the divorce does not require a showing of wrong-doing by either party or an evidentiary proceeding. Although Cynthia Rodriguez has made public A-Rod’s repeated infidelity, Florida law does not take this into account when filing for a divorce. Florida law is quite different than New York law. New York has six grounds for divorce, four of which are based on the fault of one of the parties. The fault grounds include cruel and inhuman treatment, abandonment for one or more years, imprisonment for three or more years, and adultery. The other two grounds enable a divorce to be obtained on a no fault basis, meaning neither spouse will be judged to be at fault. These grounds include one year of living apart under a separation judgment granted by a Court, or under a separation agreement signed by the parties.
